Terms & Conditions of Use

1. Acceptance of the Terms

These Terms & Conditions ("Terms") form a legal agreement between you (the "User" or your "Organization") and ChatIN Clock ("we", "us", "our"). By registering, downloading, or using the ChatIN Clock application, you agree to these Terms in full.

2. Service Description

ChatIN Clock is a time management and time-tracking application that provides:

• Clock-in/out with GPS verification
• Project and task management
• Internal team chat
• Automatic hour and payroll calculations
• Reports and analytics
• Admin dashboard for supervisors

3. Account Requirements

3.1 Eligibility

• You must be at least 18 years old
• You must have authority to represent your organization
• The information you provide must be accurate and up to date
• One person may have only one account

3.2 Account Responsibility

• You are responsible for keeping your password secure
• Do not share your account with others
• Notify us immediately if you suspect unauthorized access
• You are responsible for all activity under your account

4. Acceptable Use

4.1 You must

• Use the app only for lawful business purposes
• Provide accurate information
• Respect the rights of other users
• Comply with local labor laws
• Keep the app up to date

4.2 You must not

• Falsify GPS location or worked hours
• Access other users' data without authorization
• Use the app to harass, threaten, or discriminate
• Attempt to hack, decompile, or reverse engineer
• Use bots, scripts, or unauthorized automation
• Resell or sublicense the service without permission
• Overload or interfere with our infrastructure

5. Roles & Permissions

5.1 Employee

• Clock in/out
• View their own hours and tasks
• Participate in chat
• View assigned projects

5.2 Supervisor

• Everything an Employee can do, plus:
• Approve/reject time entries
• Assign tasks to their team
• View team reports

5.3 Administrator

• Full access to all features
• Create/edit/delete users
• Configure salaries and permissions
• Access all organization data
• Generate payroll and billing

6. GPS Location

• GPS is used only when you clock in/out
• You can deny permission, but some features may be unavailable
• Location is not tracked continuously
• Admins can view clock-in locations

7. Pricing & Payments

7.1 Subscription Plans

ChatIN Clock may offer different subscription plans (to be defined based on your business model).

• Prices may change with 30 days' notice
• Subscriptions renew automatically
• You can cancel at any time
• No refunds for partial periods

7.2 Free Trial

• A free trial period may be offered
• At the end, billing may start automatically if you don’t cancel
• Limited to one trial per organization

8. Intellectual Property

• Our property: The app, design, code, logos, and the "ChatIN Clock" brand are our exclusive property
• Your property: You retain all rights to the data you enter (project names, messages, etc.)
• License: We grant you a non-exclusive, non-transferable license to use the app

9. Data & Privacy

Personal data handling is governed by our Privacy Policy. In summary:

• Your data is yours
• You can export your data at any time
• We never sell data to third parties
• We follow GDPR, CCPA, and local regulations

10. Availability & Support

10.1 Availability

• Target: 99.5% monthly uptime
• There may be interruptions for maintenance (with notice when possible)
• We do not guarantee uninterrupted availability

10.2 Support

• Response time: 72 business hours

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The app is provided "AS IS" without warranties of any kind
• We are not responsible for:
  • Data loss
  • Lost profits or indirect damages
  • Errors in payroll calculations (you must verify them)
  • Issues caused by third parties (Apple, Google, Fly.io)
  • Misuse by employees
• Our maximum liability is limited to the amount paid in the last 12 months

12. Legal Compliance

• You are responsible for complying with labor laws in your jurisdiction
• ChatIN Clock is a tool; you decide how to use it
• Consult legal experts about time-tracking laws in your region

13. Termination

13.1 By You

• You can cancel your account at any time from settings
• Data is retained for 90 days for recovery, then deleted

13.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You fail to pay your subscription
• Your activity puts the service at risk
• Required by law

14. Changes to the Terms

• We may update these Terms occasionally
• We will notify you of significant changes by email or in the app
• Continued use after changes means acceptance
• If you do not accept the new Terms, you must stop using the app

15. Governing Law & Jurisdiction
